SOCIAL RIGHTS OF UNEMPLOYED PERSONS WITH EMPHASIS ON THE RIGHT TO MONETARY COMPENSATION IN CASE OF UNEMPLOYMENT - COMPARATIVE APPROACH

TO EUROPEAN AND MACEDONIAN LEGISLATION

Summary

The basic goal of this research is a thorough analysis of the social effects produced by the unemployment as a social risk. Usually, the unemployment is being associated to the both systems of its prevention, and its recovery. With other words, the unemployment is closely related to the Unemployment insurance system (UI), and Social assistance system (SA). Ultimately, the both of the systems have unique function, and that is the social inclusion and the financial indemnification of the persons who face the social risk of unemployment. However, there have been substantial differences between these systems in terms of their functions, goals and methodology. The aforementioned aspects have been thoroughly explained in the relevant part of this research.

The major part of this study was being dedicated to the primary system (Ul), which is the most common represent of the different models of social assurance in different countries.

The Unemployment insurance system is being adequately applied in the Republic of Macedonia as well. Its details and specificities are regulated in the Employment and Unemployment insurance law. A relevant part of this study is committed to the analyses of Macedonian unemployment insurance system, with all its specifics and details. This research answers as well, the question of the financial compensation rights of unemployed persons.
