DISABILITY INSURANCE RIGHT IN THE STATES SUCCESSORS OF THE SFRY
Summary
This work analyses the main characteristics of the disability insurance in the states-successors of the SFRY. Definitions of disability and its most important elements — general and professional incapacity for work, duration of disability, as well as the degrees of disability were specifically considered.
Croatia, Montenegro, Macedonia and Serbia have chosen general incapacity, i.e. incapacity to exercise any job instead of incapacity for work which worker has performed. Acceptation of general incapacity for work is provoked by the need for reduction of number of the beneficiaries of disability pensions. Croatia and Macedonia have constituted professional incapacity for work, while Montenegro has constituted partial disability in order to compensate lacks of the concept of general incapacity.
More degrees of disability are retained by the disability insurance in Slovenia and in the entities of the Bosnia and Herzegovina.
Compared survey of the conditions to entitlement clear point that Slovenia has retained the highest scope of the right, while Serbia has perJormed the highest reduction.
